Mon, Jun 11, 2012 at 9:10AM

A Daytona Beach Outreach Center is being sued after one of its employees hit a 9-year-old girl while driving the Center’s work van. The girl’s family filed suit in March seeking damages in excess of $15,000 after she was injured while walking to school with her brother and sister.

According to a police report, her leg was broken in the traffic accident.

The director of the Center said it was still dark outside and difficult for the driver to see the girl.

The attorneys at Seitz and Tresher have handled many different kinds of personal injury cases, and know that even the most complicated scenario can be resolved through proving the facts and applying the law.

If your child has been struck by a motor vehicle while walking, skating or riding a bicycle because of the negligence of the driver, our Daytona Beach lawyers will advise you of your rights and options for compensation.

Our Daytona Beach lawyers want you to know that if your child is injured due to the negligence of a motorist, you may be entitled to compensation for their medical bills from the insurance carrier for the owner of that vehicle. However, your child’s entitlement to damages for pain and suffering depends on the ability to prove they suffered a permanent injury as a result of the accident. Our website contains more specific information on this important topic in the Motor Vehicle Accident section.

Legal claims involving children are often subject to special legal considerations. For example, Florida law recognizes that young children often fail to comprehend danger. With that consideration, our law places a higher standard of care on motorists who know or have reason to know that children are in the area in which they are driving.

Although children have the same legal rights as adults under Florida negligence law, claims on their behalf are subject to specific statutory and procedural considerations that a Volusia County accident attorney can explain to you.

These are just some examples of the many special laws and technicalities that apply to claims involving children. All personal injury cases seek to address a number of complicated, interconnected issues. It is important to contact lawyers who have the knowledge, experience and skill in this type of case to protect your right to full compensation. An accident attorney at Seitz & Tresher would be happy to assist you in this very delicate area of the law if the unthinkable occurs.
