Cell Phone Legislation and Daytona Beach Lawyers

Legislation that would ban using a cell phone while driving in Florida is easily understood when you break it down to the essence of the argument.
A driver using a cell phone is exercising a personal freedom that many people believe should be allowed. Legislating a ban would be another encroachment on individual rights.
However, Daytona Beach attorneys continue to receive more reports, studies and research that prove how drivers distracted by cell phone use, are causing more auto accidents and making the roadways increasingly dangerous. At some point, a ban must be considered as necessary for the common good of all Florida residents.
As of August 2011, Florida was one of only a handful of states without laws regulating cell phone use while driving. According to a report by the Governors Highway Safety Association, most states have laws banning cell phone use by novice drivers or bus drivers. Nine states and the District of Columbia have banned all drivers from handheld cell phone use. Even some third world nations, such as Nicaragua, make it illegal to use cell phones while driving!
Florida, Kentucky, Louisiana, Mississippi, Nevada and Oklahoma not only have little or no restrictions, but also have barred local governments from enacting ordinances on driving and cell phone use.
The Daytona Beach attorneys of Seitz & Tresher hope the Florida Legislature will look more closely at distracted driving for the 2012 legislative session. This is something that must be addressed as more accidents occur.
If even one family can be spared the heartbreaking news of a loved one killed or injured because they or another driver were distracted by their cell phone, then enacting a legislative ban will be worth it.
